Do I have to follow my custody order during a national pandemic?

The most common question asked is whether a child custody order must be followed during a "stay at home" order.  The general answer, provided by Western Pennsylvania judges, is that parties must follow an existing custody order despite the global emergency. However, there are circumstances that may place your child at risk.  It may be necessary to file an emergency motion according to your assigned judge's emergency procedures.  Every county and each judge is different regarding policy.  It is important to contact an experienced family attorney immediately should you find yourself in this situation.  You should never withhold custody from the other party without seeking legal advice and a court order.  

Absent a true emergency, you should always reach out to the other party to resolve the issue amicably.  Parents are free to agree to a different custody schedule that benefits the child/children's safety.  Any modifications should be detailed in writing and communicated to counsel.
